These Terms of Service ("Terms") govern your use of tcpDoh network monitoring services, including the web dashboard, collector agent, and SMS alerting functionality (collectively, the "Service"). By using the Service you agree to these Terms.

1. Program Description

Program name: tcpDoh Network Monitoring
Description: tcpDoh provides automated network monitoring alerts and a two-way SMS interface for IT infrastructure teams. The Service polls managed network devices via SNMP and ICMP, evaluates performance against configurable thresholds, and delivers alerts to registered phone numbers via SMS. Users may interact with the system by replying to messages using supported commands.

2. SMS Messaging Terms

Message frequency: Message frequency varies based on network monitoring conditions and alert thresholds. You may receive alerts when devices exceed performance thresholds. During active incidents multiple messages may be sent.

Message and data rates: Message and data rates may apply. Contact your carrier for details.

Opt-out: Reply STOP to any message to opt out of all tcpDoh SMS communications. You will receive a confirmation message. After opting out you will no longer receive alerts until re-enrolled by an administrator.

3. Authorized Use

The Service is intended for IT professionals monitoring infrastructure they are authorized to manage. You agree to use the Service only for lawful purposes and only with network devices and systems for which you have explicit authorization.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your API keys and credentials. You must notify us promptly at support@tcpdoh.com if you believe your account has been compromised.

5. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service is provided for monitoring and alerting purposes; it is not a substitute for redundant network infrastructure or professional NOC staffing.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, tcpDoh SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL tcpDoh'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNTS PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED.

8. Termination

We reserve the right to suspend or terminate access to the Service for violations of these Terms or for any other reason with reasonable notice. You may terminate your account at any time by contacting support@tcpdoh.com.

9. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
